An occupation certificate is a certificate that enables an owner or occupier to legally occupy or use a building or part. An occupation certificate may be issued upon a satisfactory final inspection and receipt of the Application for an Occupation Certificate form.
There are two types of occupation certificate:
Final Occupation Certificate
A Final Occupation Certificate will be issued when
- All Internal/External Building Work, Driveway Access and Landscaping have been Completed Satisfactorily.
- All Conditions of the Development Consent have been complied with, all Building Code requirements have been Satisfied and Relevant Compliance Certificates for the Construction Components have been Provided.
Interim Occupation Certificate
An Interim Occupation Certificate permits the use of a mostly completed new building.
The intent of interim occupation certificate is to allow the use of the building while unfinished works are completed.
In order to obtain an interim occupancy certificate, the building must be completed to a level that does not constitute a hazard to the health or safety of the occupants and the building is considered habitable or usable
The building will need to be structurally adequate and all health and safety matters such as the erection of stairs/landings, provision of balustrades, installation of smoke detectors and bush fire fighting protection measures will need to be completed and operational.
